Warranty and liability

As of January 1, 2019, CONTEG provides four different warranty periods for its products, each starting on the Ex Works date (dispatch from the factory), unless stated otherwise in brochures, catalogues, manuals, price lists or this warranty document. See below for more details.

The warranty covers defects in material and workmanship and applies only if the product has been used as recommended by the manufacturer. The warranty applies only to products and/or parts. If the respective product is no longer in production, it will be replaced by the closest match from the current portfolio. For full details of the warranty, see the “WARRANTY TERMS AND CONDITIONS”.

There are four different warranty categories depending on the type of product:

Category 1: 15-year warranty

As of 1 January 2019, CONTEG provides a warranty of 15 years starting on the Ex Works date on the Category 1 products listed below. This warranty category includes the following products:

  • Free-standing cabinets (RF1, RSF, RDF, RSB, ROP, Ri7, RM7, RB1, REH)
  • Open frames (RSG4, RSG2, RS)
  • Wall-mounted cabinets (RUN, RUD, REN, ACP)
  • Cable management
  • Air flow control
  • IT accessories (except lighting).

The 15-year warranty does not apply to electronic components, such as electronic locks, monitoring devices, etc., which would be included in the delivery of customized cabinets and therefore fall under Category 3. If the respective product is no longer in production, it will be replaced by the closest match from the current portfolio.

 

Category 2: 5-year warranty

The 5-year warranty period applies to CONTEG cooling units. This 5-year warranty can only be activated by registering your product on the link website.

This category includes the following products:

  • CoolTeg Plus cooling units
  • CoolTop cooling units
  • CoolSeven cooling units
  • CoolOut cooling units
  • CoolRAC cooling units

 

The cooling units must pass the start-up procedure within six months from the date of shipment from the CONTEG warehouse. Documentation of the first start must be sent to cooling@conteg.com. Regular servicing must be carried out by a certified CONTEG partner or a CONTEG technician at least twice a year (over the entire warranty period). If this does not apply, the warranty starts on the day of dispatch from the CONTEG warehouse.  Product registration (5-year warranty) is valid if the product is registered within 6 months from the date of shipment from the CONTEG warehouse. At the same time, the cooling unit must pass the start-up procedure within 6 months from the date of shipment from the CONTEG warehouse. The warranty period on the compressor and compressor frequency converter is 24 months. If the compressor and frequency converter reach 100,000 cycles/starts, the warranty ends with the 100,000th cycle/start regardless of the 24-month warranty period.

 

Category 3: 2-year warranty

A two-year warranty as of the Ex Works date applies to industrial products (FSE, FSM, WME, OMR), LES-RACK fire extinguisher, RAMOS, PDUs, ventilation units, and ice makers. A two-year warranty period on CoolTeg Plus, CoolTop, CoolOut, CoolSeven, and CoolRAC cooling units starts on the date of the start-up procedure performed by a CONTEG technician or a CONTEG certified partner (CCSP). The cooling units must pass the start-up procedure within six months from the date of shipment from the CONTEG warehouse. Documentation of the first start must be sent to cooling@conteg.com. Regular servicing must be carried out by a certified CONTEG partner or a CONTEG technician at least twice a year. If this does not apply, the warranty starts on the day of dispatch from the CONTEG warehouse. An extended warranty can be requested at the time of purchase. The warranty cannot be extended subsequently.  The warranty period on the compressor and compressor frequency converter is 24 months. If the compressor and frequency converter reach 100,000 cycles/starts, the warranty ends with the 100,000th cycle/start regardless of the 24-month warranty period.

 

Category 4: One year warranty

CoolSpot and industrial cooling units come with a one-year warranty starting on the Ex Works date.

Warranty validity and duration


These products are subject to a one-year warranty starting on the Ex Works date.. Gastro products can primarily be purchased through CONTEG’s distribution network. For information about the distribution network, please contact insidesales@conteg.com.

 

Warranty claim process
If a product is found to be inoperable or defective, the distributor’s service department will detect the defect, describe it and include photo documentation in the “RMA” claim form available on CONTEG’s website. The RMA form is to be sent to insidesales@conteg.com. Upon receipt of your claim, we will notify you of its acceptance. Upon receipt of complete documentation, we will conduct a thorough assessment of the situation and decide on the next course of action.

 

Warranty claim resolution options


If the defect is recognized as a defect subject to the warranty and does not exceed the authorized scope of repair, CONTEG will arrange for the delivery of the necessary spare parts to the distributor who purchased the product. These spare parts will be provided to the distributor free of charge. The respective parts may only be used to rectify the defect. The cost of shipping of the spare parts is borne by CONTEG. CONTEG may request that the defective parts be sent back to CONTEG’s manufacturing plant (hereinafter referred to as “MANUFACTURING PLANT ADDRESS”).

 

In the event that the defect cannot be resolved by replacing parts or if a more serious defect is discovered, CONTEG has the right to decide to replace the entire product. In such case, CONTEG has the right to request that the defective product be sent back to the CONTEG manufacturing plant. All costs of transportation back to the manufacturing plant in the event of a more serious defect or unrepairable manufacturing defect, including the cost of shipping a new replacement product, shall be borne by CONTEG.

 

Warranty disclaimer


The product warranty does not apply in the following cases: mechanical damage to the product caused by improper use, unauthorized tampering, or unauthorized installation. Damage to the product caused by natural disasters, accidents, or other external factors beyond CONTEG’s control. Unauthorized modifications or unauthorized interference with the internal/external components of the product (without prior consultation with CONTEG). Failure to use recommended original spare parts and accessories. Failure to follow the instructions in the user manual. The warranty does not apply to the product and its parts if the serial number or numbers have been altered, damaged or removed.

 

The CONTEG gastro products are also subject to the following warranty terms and conditions, referred to in this document as WARRANTY CONDITIONS with Articles 1 to 20.

 

CONTEG GASTRO PRODUCTS - END CUSTOMER
(refrigerated showcases, wine cabinets etc.)

 

In the case of purchase of CONTEG Gastro Products by an end user (outside the distribution network), all Gastro Products are subject to the warranty terms and conditions set out hereinbelow without any exceptions. I.e., the warranty terms and conditions set out in this document marked as WARRANTY CONDITIONS with Articles 1 to 20 shall apply.

 

If a product does not fall into any of the four categories, it is deemed to belong to category 3, which means a two-year warranty shall apply to it.

 

WARRANTY TERMS AND CONDITIONS

  1. The warranty does not cover any part of the product that has been installed, modified, repaired or used in a manner that CONTEG believes could affect the reliability of the product or part thereof and/or adversely affect its performance, or is damaged as a result of the use of a tool not approved by CONTEG or a tool not approved in advance. The warranty does not apply to the product and its parts if the serial number or numbers have been altered, damaged or removed.

 

2. The warranty does not cover replacement or repair caused by loss or damage due to causes beyond CONTEG’s control, such as lightning or other natural, weather, or war-related disasters. The warranty does not cover any work required to remove or reinstall equipment or components under warranty on site, nor any work required to diagnose the need for repair or replacement. CONTEG’s warranty does not include any costs of related services or work.

 

3. CONTEG makes no warranty, expressed or implied, with respect to the fitness of its products for any particular purpose or the merchantability of its products, except that the products sold will meet the conditions set forth in the applicable description.

 

4. Any claim arising, whether relating to the delivery of the product or non-delivery of the product or otherwise, will not exceed the purchase price of the product to which the claim relates. In no event shall CONTEG or the customer be liable for lost profits or incidental or consequential damages of any kind caused by defects or deficiencies or non-delivery of the products.

 

5. The warranties and remedies provided herein are conditional upon proper receipt, handling, storage, installation and use of the products. These are products for internal or external use (depending on the product type) under standard conditions.

 

6. Notwithstanding anything to the contrary agreed in this warranty, CONTEG shall not be liable for any special, indirect, incidental or consequential damages of any kind, including but not limited to those related to unusability, lost profits or earnings, third party claims, and the Customer shall hold CONTEG harmless and indemnify CONTEG from and against all such claims.

 

7. The warranty does not apply in the following situations:

 

  • the buyer accepted a damaged shipment. The buyer is obliged to carefully inspect the shipment and if damaged, the buyer shall file a warranty claim either on his own or with the carrier, in accordance with the Warranty terms and conditions;
  • the warranty cannot be invoked after the expiry of the warranty period for the respective products;
  • the warranty cannot be invoked in the event of damage caused by normal wear and tear, accident, neglect, abuse, misuse, improper installation, improper storage, damage due to exposure to excessive temperatures and/or humidity, or indirect exposure to aggressive chemicals or extreme vibration;
  • the warranty cannot be invoked in the event of improper use of the products or their use in improper locations;
  • the warranty cannot be invoked in the event of non-compliance with the instructions set forth by the manufacturer or CONTEG;
  • the warranty cannot be invoked in the event of a defect caused by unqualified installation, misuse, mishandling or negligence;
  • the warranty cannot be invoked in the event of damage to the product caused by extreme natural phenomena.

 

8. The customer has the right to claim the warranty at the CONTEG manufacturing plant at K Silu 2179, 393 01 Pelhřimov Lhotka, Czech Republic (hereinafter referred to as the “MANUFACTURING PLANT ADDRESS”), if the defects covered by the warranty occurred during the warranty period after receipt of the products and if the defects were duly reported to CONTEG without undue delay within the warranty period. The MANUFACTURING PLANT ADDRESS is the only place where the warranty can be invoked. This warranty does not cover any costs associated with removal or installation and/or shipping of the product.

 

9. When claiming the warranty, the customer is obliged to deliver the claimed products at his/her own expense and risk to the MANUFACTURING PLANT ADDRESS together with a cover letter containing a description of the defects and the customer’s contact details. Should the cover letter describing the defects fail to be delivered to CONTEG together with the product or products, CONTEG has the right to consider the complaint incomplete, to reject it and to return the product or products to the customer at the customer’s expense and risk. All returned products must have a valid RMA number or a sticker received from a CONTEG customer service representative when the claim was raised.

 

The customer is responsible for the transport of the product or products to CONTEG and all related customs fees, taxes, insurance, etc. CONTEG shall bear the cost of transporting the product or products back from the factory to the customer provided the warranty claim has been accepted. All products that are sent back for warranty repair must have a valid RMA number issued prior to transport, which must be legibly marked on the return consignment. CONTEG strongly recommends that all products be returned in the original packaging.

 

10. CONTEG shall make a decision on the applicability of the warranty without undue delay and no later than 60 days from the date of the claim, unless CONTEG and the customer agree otherwise. Upon receipt and approval of the claim, CONTEG has the right to make a decision on how to resolve the warranty claim, i.e. to decide on the extent of a discount on the purchase price, repair, replacement or return of the products.

 

In the event that CONTEG is in default in repairing or replacing the products due to a fault solely on CONTEG’s part, the Customer shall be obliged to grant CONTEG a reasonable grace period of no shorter than an additional 15 days for the purpose of delivering on the obligation. In the event that the repair or replacement is not agreed within this additional period, the customer has the right to withdraw from the contract or claim a proportional discount on the purchase price. CONTEG reserves the right to replace a defective product with an alternative of the same quality if an identical replacement is not possible.

 

11. If the warranty claim is not accepted and CONTEG rejects the claim, the customer is obliged to reimburse CONTEG for all costs associated with the claim, payable within 5 days from the date of receipt of the decision on the claim.

 

12. CONTEG will issue a written confirmation to the customer including the date of the warranty claim and its content. Furthermore, CONTEG will issue a confirmation to the customer including the date and method of resolution of the claim, including confirmation of any repairs and the duration thereof.

 

If the claim is rejected, CONTEG will issue a written report specifying the reasons for the rejection. CONTEG hereby recommends the customer to keep such documents for the entire duration of the warranty period.

 

13. If the complaint is settled, CONTEG will return the products to the customer or provide a refund with respect to the warranty period; CONTEG will further ask the customer to accept the returned goods. The customer is obliged to accept the claimed products at its own expense and risk within 5 business days from the receipt of the notification of the decision on the warranty claim.

 

14. CONTEG will deliver these products to the customer without infringing any trademark or intellectual property.

 

15. The customer is obliged to report any defects in the products at the time of delivery and, for hidden defects, without delay as soon as such defects are discovered. Upon receipt of the shipment, the customer is obliged to check its condition.

If the shipment is damaged or otherwise visibly defective, the customer is obliged to record or specify such damage or defect on the delivery note at the moment of delivery by CONTEG or a carrier, otherwise the customer has the right to refuse the shipment.

 

If the products are delivered by a carrier, the customer is obliged to check the information on the delivery note. If the details do not correspond to the actual state of delivery, if the original packaging is damaged or the original seal or tape is broken, the customer has the right to note this on the carrier’s delivery note and either reject the defective products or reject the entire delivery. Failure to do so exposes the customer to the risk that any subsequent claim will not be accepted.

 

16. The customer is obliged to check the contents of the shipment according to the enclosed delivery note or warranty certificate. If the contents of the shipment do not correspond to the delivery note, the customer is obliged to record this fact on the delivery note or its attachments and have this fact confirmed by the carrier. If the carrier refuses, the customer has the right to refuse the entire delivery.

 

17. The customer is obliged to inspect the products upon receipt of the shipment from the carrier, and if the products contain defects that can only be detected after the receipt of the shipment, the customer is obliged to report such defects to CONTEG without undue delay but no later than 14 days of the delivery. The customer is obliged to report hidden defects to CONTEG immediately upon discovery thereof but no later than 6 months after the delivery of the products.

 

18. CONTEG makes no other warranty expressed or implied.

 

19. To ensure the correct and reliable installation of CONTEG products, customers have the option to purchase CONTEG installation assistance services that would be performed by CONTEG personnel.

For the proper functioning of CoolTeg Plus, CoolTop, CoolOut, CoolSeven, and CoolRAC cooling units, CONTEG requires customers to purchase CONTEG’s Start-up Service Package. CONTEG can also arrange for after-sales service provided either by CONTEG staff or by local CONTEG contractors.

 

20. These warranty conditions are governed by the laws of the Czech Republic except in the cases of private international law and except for the conditions set out in the United Nations Convention on Contracts for the International Sale of Goods. Any warranty disputes shall be filed to a competent court in the Czech Republic.
